The Investment and Trade Court signed two memorandums of understanding separately with the Qatar Society of Certified Accountants and the Qatar Society of Engineers, within the framework of developing the accounting and engineering expertise of the Court.
Mrs. Maryam Sultan Khalifa Al-Rabban, Managing Director of the Investment and Trade Court, signed the two memorandums on behalf of the court, with Dr. Hashem Al-Sayed signing on behalf of the Qatar Association of Certified Public Accountants, and Eng. Khaled Al-Nasr signing on behalf of the Qatar Society of Engineers.
The Investment and Trade Court stated that the signing of the two memorandums of understanding came within the framework of its endeavor to develop a mechanism for the use of Qatari experts and energies in the areas of judicial expertise to provide technical and specialized reports in the accounting and engineering fields in the cases of the court's jurisdiction, to contribute to the achievement of prompt justice and the speedy implementation of judicial expertise responsibilities.
The two memorandums of understanding affirm that the associations of accountants and engineers, at the request of the court, will submit expert reports in the relevant fields based on the Law of Establishing the Investment and Trade Court No. (21) of 2021. They also clarify the work that has been accomplished and indicate any obstacles, if any, that require the intervention of the Investment and Trade Court to solve it.
His Excellency Judge Khalid Ali Al Obeidli, President of the Investment and Commerce Court, said that the signing of the two memorandums aims to cooperate and support the quality and accuracy of the court's litigation procedures, and ensure the progress of the lawsuit settlement process within the targeted standard time. He noted that the court's law gives it the right to seek the assistance of experts even if they are not registered in the court's list of experts stipulated in the Expertise Law at the Ministry of Justice.
In a statement to Qatar News Agency (QNA), the President of the Investment and Trade Court added that the law stipulates that it is not a requirement that the expert who issued the expert report be among those registered in the experts' roster in accordance with Law No. (16) of 2017, which is the same as mentioned in Article (27) of the Investment and Trade Court Law No. 21 of 2021. It stipulates that the Investment and Trade Court may seek the assistance of experts who are not registered in the experts’ roster at the Ministry of Justice. The court also has the right to seek the assistance of offices and expert houses, whether global or local.
His Excellency confirmed that these two memoranda agreed to assign the mechanism of expertise and distribute the work according to the specialization of these associations. It was also agreed that these reports be at the highest level of accuracy and professionalism to help resolve commercial disputes and complete these reports as soon as possible.
In the same context, Ms. Maryam Sultan Khalifa Al-Rabban, Administrative Director of the Investment and Trade Court, confirmed that the two memorandums of understanding provide a good opportunity for the court to seek the assistance of experts and specialists with regard to technical aspects related to investment and trade, such as accounting and engineering work. She added, "These memorandums serve the court, the litigants, and the associations that signed them."
For his part, Dr. Hashem Al-Sayed, President of the Qatar Association of Certified Public Accountants, said that the signing of this memorandum came to support the quality, accuracy, objectivity, and professionalism of the decisions taken by the court. He indicated that the Investment and Trade Court has the vision to improve performance and speed of completion, which are the basic pillars on which the memorandum was built. The agreement was made in line with the frameworks of the law and joint coordination. He explained that according to the memorandum, the Accountants Association will undertake coordination and facilitation between experts and the court to improve the work of experts and enhance training.
In turn, Engineer Khaled Al-Nasr, Chairman of the Board of Directors of the Qatar Society of Engineers, confirmed that the Society will seek to support the court's reports related to engineering and will develop the performance presented to the court in terms of the quality and professionalism of the reports. They will also adhere to the period by accelerating the submission of reports in a way that speeds up the process of adjudicating litigation within standard time.
