On the occasion of the commencement of the new judicial year, the Investment and Trade Court held a legal and judicial panel discussion attended by Their Excellencies, the Court’s judges. The session was held as part of the Court’s commitment to promoting the exchange of legal knowledge and expertise and discussing key judicial developments.
The panel discussion was delivered by His Excellency Judge Mohammed Ahmed Ismail, Judge at the Court of Cassation, who addressed a number of legal and judicial topics related to the jurisdiction of the Investment and Trade Court, as well as recent judicial principles and rulings.
The session examined the scope of the Investment and Trade Court’s jurisdiction over cases relating to estates, the limits of the jurisdiction of the Estates Circuit, and the effect of the binding authority of judgments on disputes connected with estates, in accordance with the principles established by the Court of Cassation.
The discussion also included a comparative study of the impact of differing limitation periods applicable to cheques under the Commercial Law and the Judicial Enforcement Law. In addition, the session reviewed and explained the provisions of Law No. (8) of 2026 amending certain provisions of Law No. (4) of 2008 concerning Real Estate Leasing, and discussed the legal aspects relating to actions brought jointly by multiple claimants who are not connected by a common legal relationship.
The panel concluded with an analytical review of the most recent judgments issued by the Court of Cassation.
This panel discussion forms part of the Investment and Trade Court’s ongoing efforts to support continuous judicial development and enhance the exchange of legal expertise among judges, thereby contributing to greater judicial efficiency and reinforcing the proper application of legal principles and provisions.
