The Investment and Trade Court, in cooperation with the Judicial Inspection Authority of the Supreme Judiciary Council, organized a specialized legal seminar at the Court's premises, in the presence of the judges of the Investment and Trade Court. The seminar was held within the framework of enhancing legal and judicial culture and keeping pace with the latest principles and rulings issued by the Court of Cassation.
The seminar addressed a number of significant legal topics related to commercial disputes, with a review of recent judicial rulings and principles and their impact on the development of judicial work and the reinforcement of stability in commercial transactions.
The seminar included a discussion of rulings related to the dissolution and liquidation of commercial companies in accordance with the provisions of the Companies Law, and the withdrawal of a partner from commercial companies, in addition to a review of the concept and scope of application of Article (298) of the Companies Law and recent practical applications thereof in light of Court of Cassation rulings.
The seminar also addressed the concept of breach of the right of defense in light of recent judicial applications, as well as the judicial principles relating to payment cheques and guarantee cheques in accordance with the established rulings of the Court of Cassation, and the impact of those rulings on related commercial disputes.
The seminar further explored the issue of the suspensive stay of a judgment and the extent of the finality of the judgment thereby referred, as well as the impact of the existence of contradictory judgments between the same litigants, with a review of a number of judicial applications and rulings related to these topics.
The seminar featured extensive legal interaction and discussions among the judges, with an exchange of views and experiences on the most prominent practical issues related to the topics presented, contributing to the unification of legal understanding and the enhancement of the quality of judicial work.
In conclusion, the participants affirmed the importance of continuing to hold specialized legal seminars and meetings that contribute to enriching judicial knowledge, exchanging expertise, and keeping pace with legislative and judicial developments, in a manner that supports the development of judicial performance and enhances professional competence in judicial work.
